Terms and Conditions of the officecatering.zatisigroup.cz e-shop

The company Fresh & Tasty by Zátiší s.r.o., with its registered office at Novotného lávka 5, 150 00 Prague 1, Company ID No.: 26154641, VAT ID No.: CZ26154641, is part of the Zátiší Group holding.

The operator of the e-shop is Fresh & Tasty by Zátiší s.r.o., with its registered office at Novotného lávka 5, 150 00 Prague 1, Company ID No.: 26154641, VAT ID No.: CZ26154641 (hereinafter referred to as the “Seller”).

The subject matter of trading in the e-shop consists of products offered by the Seller and divided into the relevant categories. Delivery and payment terms are set for each category.

Prices of products offered in the e-shop are valid at the time of ordering and form part of the order confirmation that each customer receives after completing and submitting the order. Prices are stated in CZK excluding VAT. The total order price also includes any delivery costs (shipping).

Order: By submitting a properly completed order by the customer and its confirmation by the Seller, a purchase agreement is concluded between the parties.

Order changes and cancellation: The customer may change or cancel a submitted order within 30 minutes of submission, by phone or by e-mail using the contact details stated above in the Contact details section of these Terms and Conditions.

The Seller reserves the right to cancel an order or part of an order if the input ingredients for producing the offered products are temporarily unavailable. Should this situation occur, the Seller will contact the customer without undue delay in order to agree on the further procedure.

If the customer has already paid part or all of the purchase price, such amount will be transferred back to the customer’s account.

Retention of title: The Seller reserves title to the products until the purchase price has been paid in full. A cash receipt, invoice or receipt issued on the basis of the purchase agreement between the Seller and the customer also serves as a tax document.

Delivery terms: When placing an order in the e-shop, the customer chooses the delivery/collection option.

Delivery/collection options are:

Delivery to the selected location (the Operator’s own transport, Liftago courier service, Wolt) and personal collection.

 

Payment terms: When placing an order in the e-shop, the customer chooses the payment option.

Payment options are: By payment card. For corporate customers registered and authorized by the Operator, payment by invoice is available.

 

Right to withdraw from the contract / returns: The products offered in the Seller’s e-shop are food items with a limited shelf life. The shelf life lasts until the end of the day following the day of delivery. Products must be stored at 0–6 degrees Celsius.

In this case, the customer’s right to withdraw from the contract and return the goods within 14 days without stating a reason does not apply.

Complaints: Upon receipt of the delivery, the customer is required to check the quantity and visual quality of the products. By paying the purchase price upon personal collection or by signing the transport document/delivery note, the customer confirms that they received the shipment without apparent defects and in the stated quantity. Later complaints regarding quantity and apparent defects will not be taken into account.

If the customer complains about hidden defects in the delivery that were not apparent upon receipt, they must do so without undue delay, no later than 24 hours after receipt of the delivery. Later complaints will not be taken into account.

Complaints regarding hidden defects may be made by phone, e-mail or in person using the contact details stated in the Contact details section of these Terms and Conditions.

If a complaint is accepted, it will be resolved as agreed between the customer and the Seller, either by replacement delivery or by a refund. The place and date of resolving the complaint will also be determined by agreement.

Shelf life / warranty period: The products offered in the Seller’s e-shop are food products. The shelf life lasts until the end of the day following the day of delivery, unless otherwise stated on the packaging. Products must be stored at 0–6 degrees Celsius.

 

Personal data protection: Customers’ personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. By providing data for registration, the customer/visitor agrees that the Seller processes and uses the provided data for the Seller’s internal and marketing purposes and for the internal and marketing purposes of companies belonging to the Zátiší Group, according to the Zátiší Group Business Partners Data Protection Statement available in full at: https://www.zatisigroup.cz/cz/pdf/gdpr-cs.pdf/

In accordance with Act No. 480/2004 Coll., the customer agrees to receive informational e-mails

Final provisions:

  • These Terms and Conditions apply in the wording published on the Seller’s website on the day the electronic order is submitted, unless otherwise agreed in writing by the parties.
  • By submitting an electronic order, the customer accepts without reservation all provisions of these Terms and Conditions in the wording valid on the day the order is submitted and, on the day the order is submitted, also accepts the valid purchase price of the order, unless proven otherwise agreed in a specific case.
  • By submitting an order (concluding a purchase agreement), the customer is irrevocably bound by the order for the period specified for delivery of the goods. The parties expressly agree, pursuant to Section 262(1) of the Commercial Code, that unless expressly stated otherwise in these Terms and Conditions, their rights and obligations are governed by the Commercial Code of the Czech Republic, in particular Sections 409 et seq.
  • Validity of the Terms and Conditions: from the date of issue until the date a new wording is issued
